These General Terms and Conditions (hereinafter General Terms and Conditions) apply to the services provided by Haus Martina to the guest.
​
The services consist in particular of paid accommodation, the rental of premises and all related other services of the apartment house.
Haus Martina, refers to the online offer www.haus-martina.at, represented by Sabine Moser, Kasperdörfl, 5550 Radstadt.

The general terms and conditions apply when renting the apartments from Haus Martina.
​
§.1 The guest accommodation contract is considered concluded when the apartments have been ordered by the guest and confirmed by the landlord. Both the written and the short-term oral form are binding for the confirmation. The guest accommodation contract obliges the guest and landlord to comply with it and is only concluded between the landlord and the guest and the people accompanying them. Unauthorized accommodation of foreign guests will be charged at twice the basic overnight rate.

§.2 The landlord undertakes to provide the guest with the apartments in perfect condition in accordance with legal regulations or customary market practices. He is obliged to provide the guest with alternative accommodation or to pay compensation if he is unable to provide the promised apartments despite confirmation.

§.3 If the guest withdraws from the contract before the start of the stay or arrives later or leaves earlier than agreed, he is obliged to pay the landlord the agreed rental price for the days on which he does not use the reserved apartment minus the saved own costs. Payment is due at the latest on the day of arrival of the agreed rental period and must be made in advance.

§4 Cancellation of the rental agreement. We allow our guests to cancel free of charge up to 30 days before the start of the rental period. The costs for cancellations up to 14 days before arrival are 30% of the agreed rental price; for short-term cancellations from 7 days before arrival, the cancellation fee is 70% of the rental price.

Cancellations and changes made late as well as no-shows will be charged with the total amount.

§5. The arrival day is considered a rental day and will be charged as such. An overnight price is agreed. On the day of arrival, the holiday apartment ordered is available to the guest from 3 p.m. On the day of departure, the guest must leave the holiday apartment by 10 a.m. to give the landlord the opportunity to prepare it for the next guest.

§6. The rental property is handed over to the tenant in a clean and contractual condition. If there are defects upon handover or the inventory is incomplete, the tenant must immediately report this to the key holder/landlord. Otherwise, the rental property is deemed to have been handed over in perfect condition. If any damage occurs in the apartments caused by the guest, the guest will be liable for it; The guest is liable for all people accompanying him.

§7. The customer's personal data is only collected within the framework of the statutory provisions of the Austrian Data Protection Act.

§8th. Upon receipt of the booking confirmation, 20% of the booking price must be paid as a deposit. Payment information will be provided with the booking confirmation.

§9. The additional costs (such as electricity, gas, heating, tourist tax, etc.) are included in the rental price.
Bringing dogs requires our consent. The guest is obliged to indicate in advance if they wish to bring one or more pets. If we agree to bring pets If you agree, this happens under the condition that the pets are under the guest's constant supervision, are free of diseases and do not otherwise pose a danger to the other guests.

§10. The place of jurisdiction is the place of business, i.e. the place in which the holiday apartment is located and in which the services from the guest accommodation contract are to be provided, in this case the Kitzbühel District Court. Payment is required on the day of departure at the latest; the agreed rental price can also be paid in advance. The tenant expressly agrees to this provision.

§11. Salvatore Clause: Should one or more provisions of these General Terms and Conditions become ineffective, this will not affect the effectiveness of the remaining provisions. The invalid provision must be replaced by an effective one that comes closest to the economic purpose pursued by the invalid provision.
